Pennsylvania Lawmakers Weigh Age-21 Kratom Regulation as Health Department Reviews Options

Pennsylvania legislators are weighing proposals that would regulate kratom sales rather than prohibit the plant outright, according to Pennsylvania Capital-Star reporting republished by WESA. The bills with the most momentum would allow natural kratom leaf to be sold to adults 21 and older while banning synthetic products and highly potent extracts. None has yet reached the governor’s desk.

House Bill 2058, introduced by Reps. Emily Kinkead and Jim Prokopiak, would bar sales to anyone under 21, ban synthetic kratom products, and require product testing and labelling. Prokopiak said the House proposals would place liability on sellers rather than criminalize possession. In the Senate, Sen. Tracy Pennycuick (R-Montgomery) is sponsoring a bill that would bar synthetic products and those exceeding 2% 7-OH concentration.

The state Department of Health said it is reviewing its options and seeking feedback, while two county district attorneys have asked it to use emergency powers to schedule 7-OH and kratom derivatives. The American Kratom Association backs a Kratom Consumer Protection Act model built on labelling, product criteria, and age limits.
